With 65 votes in favor, 22 against and 36 abstentions, the Chamber of Deputies approved the Personal Data Project , an initiative that has been in process for 7 years and whose objective is to regulate and protect the processing of personal data in different areas.
The Project
The initiative, inspired by the General Data Protection Regulation (GDPR), was presented in 2017 by senators Pedro Araya and Alfonso De Urresti, and former senators Alberto Espina, Felipe Harboe and Hernán Larraín, and seeks to improve the rules relating to the processing of personal data of individuals, so that this is carried out with the consent of the owner of said data or in cases where authorized by law.
On the other hand, it creates the Personal Data Protection Agency, a public body responsible for ensuring the protection of personal data, ensuring standards of quality, information, transparency and security.
The most relevant points
The law establishes that personal data may only be processed lawfully and fairly, for specific, explicit and lawful purposes. It also introduces essential rights for data subjects, such as access, rectification, deletion, opposition, portability and blocking of their personal data. These rights are non-transferable and non-waivable, giving individuals absolute control over their personal information.
Likewise, data processing on page seo service will only be legitimate if it has the free, informed and specific consent of the owner, although the law provides for exceptions in cases where it is necessary to comply with legal or contractual obligations.
One of the pillars of the project is the creation of the Personal Data Protection Agency. This entity will be an autonomous corporation with legal personality and its own assets, responsible for monitoring compliance with the regulations and protecting citizens' privacy. The agency will also be responsible for managing the system of infractions and sanctions that the law establishes for those who violate the regulations.
Controversial Issues and Debate in the House
The approval process was not free of controversy. The main discussion revolved around the sanctions that could be applied to companies that break the law, with a sector of the opposition expressing its rejection, considering that these fines are disproportionate and could negatively affect small and medium-sized enterprises (SMEs). It was argued that these sanctions could discourage investment in Chile, especially in the technology sector.
